By accessing and using editBrain ("the Platform"), operated by imedia8, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.

2. Description of Service

editBrain is a media asset management and video editing platform that provides AI-powered video analysis, track-based video editing, asset sharing, and related services. Access is provided on a per-client basis through authenticated accounts.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

• Upload content that infringes on intellectual property rights of others.
• Use the Platform for any unlawful purpose.
• Attempt to gain unauthorised access to the Platform or its infrastructure.
• Interfere with or disrupt the Platform's operation.
• Share your account credentials with unauthorised third parties.

5. Intellectual Property

Content you upload to editBrain remains your intellectual property. By uploading content, you grant us a limited licence to process, store, and display it as necessary to provide the Platform's services. editBrain's software, branding, and design are owned by imedia8 and protected by intellectual property laws.

6. AI-Powered Features

The Platform uses third-party AI services (including OpenAI, Google Cloud Vision, and AWS) to analyse and process your content. By using these features, you acknowledge that your content may be processed by these third-party services in accordance with their respective terms.

7. Data & Storage

We store your uploaded assets and associated metadata on our servers. While we take reasonable precautions to protect your data, we are not liable for data loss. You are responsible for maintaining your own backups.

8. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the fullest extent permitted by law, imedia8 shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

9. Termination

We may suspend or terminate your access at any time for violations of these terms. Upon termination, your right to use the Platform ceases immediately. We may retain your data for a reasonable period to comply with legal obligations.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the United Kingdom. Any disputes shall be resolved in the courts of England and Wales.
